LOAN TERMS: RATES, REPAYMENT, AND FEES (SUMMARY)
This section is a high-level overview of common terms that may be shown in the Services. Payday Brin is a comparison platform, not a lender, and does not set credit terms. Exact terms are determined by the independent provider you choose and will be disclosed by that provider before you accept any agreement.
A) APR RANGE
Annual Percentage Rate (APR) is the yearly cost of borrowing expressed as a percentage and may include interest and certain applicable fees. Depending on your eligibility and the provider’s offer, the APR for products that may be available through the Services can be up to 35%. The provider will disclose the APR and any applicable fees before you proceed.
B) REPAYMENT PERIODS
Repayment periods vary by provider, product type, and state rules. Typical repayment terms range from 3 to 24 months, depending on the option you select and what is permitted in your state. Your payment schedule, due dates, and total repayment amount will be provided by the provider before you finalize an application or accept an offer.
C) FEES AND OTHER CHARGES
Providers may charge fees (for example: origination fees, late fees, returned payment/NSF fees, or optional expedited funding fees). Any fees and the total cost of credit will be disclosed by the provider before you accept an offer.
These Terms of Use (“Terms”) are a binding agreement between you (“you,” “your,” or “User”) and Payday Loans Brin LLC (“Payday Brin,” “we,” “us,” or “our”). They govern your access to and use of the Payday Brin mobile application, website (paydayloansbrin.com), and related services (collectively, the “Services”).
By downloading, installing, accessing, or using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1) KEY DISCLOSURES (PLEASE READ)
1.1 Payday Brin is not a lender.
Payday Brin is a comparison platform. We do not:
• lend money or issue loans,
• set interest rates, fees, repayment schedules, or other credit terms,
• make credit decisions or determine eligibility.
Any loan, cash advance, or other financial product you choose is offered by an independent third-party provider, and your agreement is directly with that provider.
1.2 No guarantee of approval or funding.
Availability of products, approval decisions, funding speed, and exact terms are determined solely by the provider and may vary by state, your qualifications, and provider requirements. We do not guarantee that you will receive an offer or funding.
2) ELIGIBILITY AND YOUR RESPONSIBILITIES
To use the Services, you must:
• be at least 18 years old (or the age of majority in your state),
• be located in the United States,
• use the Services for lawful, personal, non-commercial purposes,
• provide accurate, current, and complete information when requested.
You are responsible for maintaining the confidentiality of any verification codes or sign-in methods used to access the Services and for all activity that occurs through your device.
3) WHAT THE SERVICES DO
The Services are designed to help you explore and compare cash advance and personal loan options. Depending on the flow, you may:
• select an amount and provide limited details to view options,
• review key terms presented in the Services,
• choose to proceed to a third-party provider to apply or continue.
If you proceed to a provider, that provider’s terms, privacy policy, and application process apply. Payday Brin is not responsible for the provider’s products, services, decisions, or customer support.
4) ELECTRONIC COMMUNICATIONS AND TEXT MESSAGES (SMS)
By using the Services, you consent to receive electronic communications related to your use of the Services, which may include:
• in-app notices,
• emails,
• text messages (SMS), including one-time verification codes.
If you choose phone verification, we may text you a one-time code to help confirm it’s you. Standard messaging and data rates may apply. If you do not want to receive authentication-related texts, do not use phone-based verification and discontinue use of that feature.
We may still send messages that are necessary to provide the Services, respond to support requests, or comply with legal requirements.
5) INFORMATION YOU SUBMIT; AUTHORIZATION
When you submit information through the Services, you authorize us to:
• process your information to provide the Services,
• transmit the information you provide to third-party providers you choose to engage with,
• use service providers (such as hosting, analytics, fraud prevention, and customer support tools) to operate and secure the Services.
You represent that the information you provide is truthful and not misleading. Providing false or incomplete information may result in denial of access to certain features or suspension of your use of the Services.
6) PERMITTED USE AND PROHIBITED ACTIVITIES
You may not:
• use the Services in violation of any law or regulation,
• attempt to gain unauthorized access to systems, accounts, or data,
• scrape, crawl, or use automated tools to extract data from the Services,
• upload or transmit malware or harmful code,
• reverse engineer, decompile, or attempt to discover source code,
• copy, modify, distribute, or create derivative works of the Services or content without written permission,
• use the Services to send spam, unsolicited marketing, or unlawful communications.
We may suspend or terminate access if we reasonably believe you violated these Terms or engaged in fraud, abuse, or prohibited activity.
7) FEES; OUR COMPENSATION
7.1 No consumer fee to use Payday Brin
We do not charge you a direct fee to download or use the Services as a consumer.
7.2 Compensation from providers
We may receive compensation from third-party providers (for example, referral or marketing fees) when users click through, apply, or complete certain actions with a provider. Any compensation does not change the provider’s terms offered to you.
8) THIRD-PARTY SITES AND PROVIDERS
The Services may link you to third-party websites or provider platforms. We do not control and are not responsible for third-party content, availability, privacy practices, products, or services. Your relationship with a provider is governed by that provider’s agreements and disclosures.
9) INTELLECTUAL PROPERTY
The Services and all related content (including text, graphics, logos, software, design, and compilations) are owned by Payday Loans Brin LLC or its licensors and are protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, lawful use in accordance with these Terms.
10) DISCLAIMERS
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or completely secure, or that any information shown will always be current or available.
11) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYDAY LOANS BRIN LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY THIRD-PARTY PROVIDER.
TO THE EXTENT ANY LIABILITY IS FOUND DESPITE THE ABOVE, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED USD $100.
Some states do not allow certain limitations, so parts of this section may not apply to you.
12) INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Payday Loans Brin LLC and its affiliates, officers, employees, partners, and agents from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:
• your use or misuse of the Services,
• your violation of these Terms,
• your violation of any law or regulation,
• your infringement or violation of any rights of any person or entity.
13) GOVERNING LAW; DISPUTE RESOLUTION; ARBITRATION
13.1 Governing law
These Terms are governed by the laws of the state in which Payday Loans Brin LLC is organized, without regard to conflict-of-law rules, and applicable federal law.
13.2 Binding individual arbitration; class action waiver
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration on an individual basis under the Federal Arbitration Act, not in court.
You agree:
• no class actions, class arbitrations, or representative proceedings,
• claims may be brought only in your individual capacity.
If arbitration is found unenforceable for a particular claim, that claim will be resolved in a court of competent jurisdiction, and all other claims will remain subject to arbitration to the extent permitted.
14) TERMINATION
We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or your use is harmful to us, providers, or other users.
You may stop using the Services at any time by deleting the app and discontinuing use.
Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
15) CHANGES TO THESE TERMS
We may update these Terms from time to time. When we do, we will update the Effective Date at the top of this page. Your continued use of the Services after changes become effective means you accept the revised Terms. If you do not agree, you must stop using the Services.
16) APPLE-RELATED TERMS (iOS USERS)
These Terms are between you and Payday Loans Brin LLC, not Apple Inc. Apple is not responsible for the Services or their content and has no obligation to provide support.
